1. Agreement
By accessing or using this website, you agree to be bound by these Terms of Service. If you do not agree, please stop using the site. You must be at least 13 years old to use 808 Food Trucks.
2. Platform Role
808 Food Trucks is a directory and promotional platform. We are not the owner or operator of any listed food truck and do not control menu pricing, health standards, permitting, or customer interactions at a listed location. Some listing content may be drawn from publicly available online sources and is used for directory purposes only. We do not guarantee availability, timing, quality, safety, cleanliness, or pricing at any truck. All listing details are provided by vendors and/or online sources and may be incomplete, delayed, or inaccurate.
3. Vendor and User Responsibilities
Vendors are solely responsible for maintaining accurate listing details, hours, photos, permits, licenses, and menu content. Users are responsible for how they use the directory, and you agree not to misuse contact information, scrape content, impersonate others, or post illegal or harassing material.
808 Food Trucks may remove or disable listings and suspend accounts if content or behavior violates these Terms or applicable law.
4. Content License
You represent that any content you submit (text, photos, links, or logos) is your own or properly licensed. You grant 808 Food Trucks a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content for platform operations. Some photos on 808 Food Trucks may be stock images used under third-party licenses; we do not claim ownership of such third-party media.
5. Fees, Payments, and Services
If you use paid vendor services, those fees are non-refundable except where required by law or expressly stated in a separate order/payment confirmation. Payment processors and third-party providers have their own terms, and you agree to those terms when using those services.
6. Disclaimers and Limitations
The site is provided on an "as is" and "as available" basis. We make no warranties of any kind, including fitness for a purpose, non-infringement, uninterrupted service, or data accuracy.
To the fullest extent permitted by law, 808 Food Trucks is not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, from your use of the platform.
You agree that your use of any listing is at your own risk. 808 Food Trucks is not liable for vendor-specific actions, vendor disputes, food safety incidents, delays, menu changes, temporary closures, vehicle access issues, or public-health concerns associated with food truck visits.
To the extent liability cannot be excluded, our total liability is limited to the greater of: (a) fees you paid directly to 808 Food Trucks in the 12 months before the claim, or (b) $100 USD.
7. Indemnification
You agree to defend, indemnify, and hold harmless 808 Food Trucks, its team, and representatives from any claim, demand, damages, or expenses (including legal fees) arising from your content, your misuse of the service, or your violation of law, including claims related to third-party content, photos, logos, or IP rights.
8. Intellectual Property
All trademarks, graphics, text, and software on this site remain our property unless noted otherwise. You may not copy, reverse engineer, or commercially reuse our materials without written permission.
9. Dispute Resolution
These Terms are governed by the laws of the State of Hawaii. Any dispute must be brought in the state or federal courts in Hawaii unless you contact us first to seek informal resolution.
10. Changes and Contact
We may update these Terms at any time by posting revised terms on this page. Continued use after updates means acceptance. Use the site contact form for questions or notices.
11. Copyright and Takedown Requests
If you believe content on 808 Food Trucks infringes your copyright or other intellectual-property rights, submit a rights complaint through our contact channels. Include the following information:
- Your contact information and a valid email address.
- Clear identification of the specific content you believe is infringing.
- Evidence of your ownership or authorization to act on behalf of the rights holder.
- A statement that you have a good-faith belief the use is unauthorized.
- A statement that your notice is accurate and provided under penalty of perjury.
We will review all notices and, when appropriate, remove or disable access to the challenged material while we investigate.
Submitting false or bad-faith notices may expose the sender to liability for misuse of process and related costs.
